You must file a suit in the family court for child custody. As the child is only 1 year old the mother has legal right for custody but if you can prove that the mother is incapable of taking care of her like if she is insane, or no good environment for the child, or she is leading immoral life etc. that means you have to prove that the child will stay safe and sound with the father then the court may consider to give the baby to the father based on the baby's welfare.
