You are the legal guardian of your 7 months daughter while the mother of the child may have custody of the child. After/ before divorce you have little chance to get the custody of your daughter as she's only 7 months old.

What you can do is -apply to the family court for visitation order that is court will decide times and days when you may meet your daughter. To get custody of your child you have to wait till her puberty or if the mother remarries or the mother has severe sickness or if she lives an immoral life or if the child is not safe with the mother for other reasons that the court may think proper then the court may pass custody order in favour of you.
